Whenever an original song, with lyrics or instrumental music, is “fixed” in a tangible medium (recorded or written down), a copyright is generated. The copyright owner of a song is entitled to certain exclusive rights in the song under the U.S. Copyright Act. Therefore, only the copyright owner of a song can use the song unless someone pays him to use it. When a copyright owner allows someone else to use his music, the owner is really granting a license in the copyright. A license is a legal agreement between two or more parties that allows one party to use something that another party owns, but does not transfer ownership from one party to the other. The money from these licenses is called publishing.
1. Registration with Library of Congress and optionally, with the PRO (ASCAP, BMI, SESAC) with whom the publisher and/or songwriter are affiliated. Registration provides best protection in the event of copyright infringement.
The three main PROs in the United States are BMI (Broadcast Music, Inc.), ASCAP (American Society of Composers, Authors, and Publishers), and SESAC (Society of European Stage Authors and Composers). Each of these works basically the same way but with a few slight differences. Each boasts thousands of members and many great artists and performers. For instance BMI has over 350,000 members including Jimmy Buffet and The Beatles. ASCAP also has over 300,000 members including Elvis Costello, Jay-Z, and Alan Jackson. SESAC has Garth Brooks and Bob Dylan in their stable.
2. Exploitation – can include sales of CDs, downloads, ring tones, video games, film, tv, advertising and many forms of different commercial licensing usages.
3. Collection – getting the money for the mechanical royalties plus any/all other licensing fees which are sold.
Summary of music publishing
Even as the music industry changes, publishing will always be the “constant” at the center, so it’s important to understand the publishing side of the music business. For example, even if CD (compac discs) sales completely fade out, there will still be mechanicals, synchronization, performance royalties and other streams of income from dozens of traditional and new commercial music licensing types.
License Music wolfiesmusicpublishing.com
Publishing is concerned with the registration, exploitation (Sales), and collection of the copyright.
1. Royalties paid to the songwriter/composer (could be same as publisher) are the mechanical royalty which covers the composition.
2. Royalties are also paid to the performer of the song, which can be the same as the publisher and/or record label.
Publishing is focused primarily on the royalties paid to the songwriters and composers. If you are just starting out, you will most likely be a self-published publisher, which is very common these days, and is the best way to build and expand your future music publishing career and licensing opportunities.
Songwriters receive the following royalties
1. Mechanicals for the composition of the music – paid by the label to the songwriter for the rights to “mechanically reproduce” the writer’s song on CD or download. Note, this occurs whether or not the writer is the performer of the song.
2. Performance – Paid by the Performance Rights Organizations (ASCAP, BMI, SESAC), to the writer(s) of the song when the writer’s music is broadcast over the public airwaves, such as radio, tv, satellite, internet, etc. Note, some music publishers and libraries also do direct, “per program” licensing deals with broadcasters or other businesses using their music.
3. Synchronization for use of music with visual media such as film, videos, slide shows or games, etc. – Paid by the producer of a movie, tv show or ad agency to the writer of the song for the right to “synchronize” the writer’s music to the producer’s moving images.
4. Special use – paid by creators of ring tones, karaoke, video games, etc. to the songwriter for the rights to use the songwriter’s composition work.
5. Print – When music gets published in song books, sheet music or other transcriptions, the royalties are paid to the publisher and the songwriter.
It is important for you as an artist or someone involved with artists, to understand how music publishing works to generate money, but also to generate interest and audiences to continue growing your publishing career and related opportunities. To learn more about the most common music licenses categories and types, I would recommend Types of Music License article.
There are many ways to help advance your career if you want to. Many people are waiting for OTHERS to do it for them but the truth is NO ONE CARES more about YOUR music than YOU! I cannot begin to tell you about how many artist and bands approach me wanting to be FAMOUS or what ever but are doing absolutely NOTHING about trying to achieve their goals.
I wanted to maybe share a few ideas that may help you in your endeavors.
To earn a good living in the music industry, you MUST develop a specific plan for how you will reach your goals. If you merely fantasize about making a lot of money, this is not enough to make this goal a reality. Rather than fantasizing, start working toward what you want to achieve by asking yourself the following questions:
What are you doing to build your music career?
What are you wanting out of your musical career ?
Who are you surrounding yourself with ?
Where do you see yourself in 5 yrs? of 2 yrs? even in 6 months?
How are your going to get to where you want to be?
After you have figured out your answers for each question above, you must focus on making every action you take in your music career go toward achieving the exact goals you have made for yourself.
Most musicians looking to become successful in the music business are not sure what they must do to reach their desired goals. If you are experiencing this as well, the best solution to this problem is to seek out training from a professional who has shown other musicians how to earn a lot of money in their careers. This way, you can avoid making mistakes that will cost you significant time and effort to fix.
If you are looking for information on how to start your journey, or looking for help to build upon that which you have already started, then I would ask you to please send me an email with some info about yourself and maybe I can help.
I will write more in the days to come in the mean time take some time to think about and answer the questions about. The answer may surprise you. A lot of people just say, ” I am going to be a big star, make all kinds of money” but they do not know how to accomplish this, or who to have help them. I may not have all your answers but I feel I can help you in your journey.
OVER 200 POPULAR ONLINE AND BROADCAST COMMERCIALS AFFECTED INCLUDING: PEPSI, COCA COLA, CHEVROLET, BUD LIGHT,
CADILLAC, BEST BUY, AT&T, KODAK, MICROSOFT
WAP Publishing has terminated their agreement with the UK-based MoFilm as of March 2012, due to non-payment of the license fees. WAP worked with MoFilm and provided them with music for over 200 online and broadcast commercials. All of these commercials continue to exist via broadcast and digital media and are viewed globally. Almost all of these commercials are now unlicensed and their music synchronization licenses have expired or they have been revoked for non-payment.
WAP Publishing represents many individual composers like, Atlanta-based Mark Allan Wolfe. The problem grew wider when companies like: AT&T, Chevrolet, CocaCola, Pepsi, Unilever refused to respond to any WAP correspondence notifying them of MoFilm’s lawful termination.
“We have contacted many of the 39 (primarily) US-based companies informing them months ago, how MoFilm has been terminated. We thought this proposed transference would be a simple matter. We assumed each company would handle it in an appropriate manner and respect the copyright of others, in the same way they so proudly and fiercely defend their own copyrights.
We explained how MoFilm was not paying WAP. In fact, as the licensor, all potential licenses should be contacting WAP directly. If all the brands would please contact us, WAP Publishing will gladly restructure an agreement on behalf of our songwriters/musicians”,Guy Ratcliffe/CEO WAP Publishing said.
Composer Mark Allan Wolfe said, “At first, I gave them the benefit of doubt until it amounted to be too much. If it weren’t for Guy Ratcliffe stepping in, I doubt I would have been paid anything. As payments diminished, became less frequent to then, none at all, it seemed clear, they were violating our agreement blatantly. Guy and I contacted our legal counsel Bienstock & Michael – Hackensack, NJ about the problem with MoFilm”. www.markallanwolfe.com
WAP worked with MoFilm for over two years, dating back to 2010.WAP has tried every known way to rectify this. It is with great regret that WAP has to make this an international public issue. WAP does not want to embarrass the 39 brands involved, but the indifference and non-responsive stance – encountered to date – has forced WAP to go public. For further details and to view some of the commercial videos referred to, please see our blog at www.wappublishing.com.
Here is the full list of the brands affected, totaling over 200 instances of internet and TV broadcast commercials:
AMERICAN RED CROSS MICROSOFT
AT&T MOUNTAIN DEW
BEST BUY NATARAJ PENCILS
BUD LIGHT NATURE VALLEY
CHEX MIX PEPSI
COCA COLA RENAISSANCE
COKE LIGHT SATPUDA FOUNDATION
COKE ZERO SEVEN BAR
FINDUS SOVEREIGHN BANK
HIDUSTAN TIMES SURF EXCEL
LEGO VITAMIN WATER
Visit Wap Publishing BLOG and watch several of the said TV commercials, web adverts, film competition submissions and more. It is of course not a FULL listing though but a big one at that.
As many of you who know me, I am a very mellow easy going person who loves people and hate confrontation but not afraid to go forwards when needed. After a long time of thought and trying to resolve something a certain way I feel the need to publish certain things we have been dealing with in hopes to fix things that are broken. I share this information with the hopes of building a bridge of communication and restoring relationships as well as getting paid for services rendered.
Here are a few more ideas I wanted to share with all of you. I have been thinking about all the people and composers out there who reach out to me and ask a lot of questions, so I wanted to share a few things that have helped me a long the way.
I also want to let you know I do these very things also so I am not above anything here. I really believe it. If you want it you need to go get it and work hard, NO ONE will give it to you. For starters it’s really worth while doing some research on your possible clients or potential music supervisors or film makers – looking at their previous jobs and the styles they usually work with. I find that one good place to start your search is Linked In – which also helps you see where people move to when they change jobs.
Spirit of Rock-Mark Allan Wolfe
Remember that there are hundreds of other composers out there all trying to get work – what is your unique angle/what will get you remembered? What is your sound like? Did you send something unusual in the mail? did you make a funny making of video for one of your tracks – try and stand out. Marketing yourself should take at least 50% of your time…Remember NO ONE ELSE WILL!!
Do some market research before you start sending examples of your work around. Try and find out who you need to send you work to and what kind of thing they are looking for and what format they want to see it on, eg DVD, an internet link or whatever.
If you do it and try your best and faint not it will come to pass. It may take a while but if you do it and have the chops and determination eventually people will listen. It may take a long time before you are financially self sufficient to compose full time. You may have to supplement your income with other types of musical work. However if you have talent and determination it can be one of the best jobs in the world.
Feel free to share this and network with me and sign up or follow me on twitter, facebook or where ever. You never know who is listening and watching or when someone will call asking for your style of music.

So I thought I would try something new today. Always looking for something to cause a stir or get folks like you into learning about my music. I probably do not try hard enough but none the less you need to start somewhere.
I was thinking about how inspiration comes to me and maybe you but it usually comes as a surprise. A sort of wind that fills your heart and mind. Perhaps it is this way with you but today while cleaning I started hearing this melody come thru into my mind. I was thinking yes I dig this now only if I can just get it out of my mind and into music we would be cool. This is the never ending struggle we as musicians, songwriters or composers feel. It is like this passion that fills us, to strive to get it all out there and see what sticks. Some times it is just for you, others it is something for everyone.
Then you have fight past your own feelings and emotions for you constantly wonder, “what will people think?” I always try to throw those thoughts and caution to the wind. Let the muse lead you to the song. Not an easy thing to do hence we try anyways.
So I thought it might be interesting to share this humble journey with you and express what it is that goes on inside the heart when one tries to compose or write music. Now I must also admit and confess something terrible. I do not know how to accurately write out the music. I understand it, I know the chords most of the time, yet it is very difficult and mundane for me to be a copyist and scribe out the notes one by one. I do not have the patience or the desire to do so. I am more happy to try and find the song this way than the other. So lets begin. Over the next few postings I will begin to share a bit about the songs and we shall see what comes of it.
I would also encourage you if you listen to my music, please comment or share an email as some of you have already done, and explain or share your thoughts either GOOD or BAD on my music. I read every email and endeavor to learn and respond to each one, although not as fast as I would like. So if you dig it or hate it give me a word about it but please do not be vulgar or use curse words. LOL Well onward ho and lets begin….
Well I was wanting to share a few new videos I made and created recently. I do hope you enjoy them. The songs are a few years old but the videos are new. These songs have meant a lot to me over the years. I had a lot of fun creating the music and recording them. There is a story behind each one but I guess if your interested I can always tell the story just email me and ask me to share what is behind the songs if your interested.
The song first is LOVE SONG a vocal song I wrote for my wife and I hope you like the music as well as the lyrics. On this track is my vocals and I also played all the instruments as well.
The second song is called PEACE. A song created about 10 years ago I recorded it in a small studio in southern Indiana. Again I performed all the music and arranged everything. This song has special meaning to my heart as well many different emotions going thru the head during the creation of it. I remember it was spring and the the trees where bursting with green and bird where singing there songs of love hence it was a very magical time yet inwardly I was a mess. So enjoy it.
So here you are pressing onwards so to say. You have created all sorts of music designed the CD’s, got tours lined up or at least some gigs even if they are just playing parties for the time being. None the less you got something going. You have a dream, a desire to share your music with the whole world, yet you do not know where to start. Perhaps you do know where to start yet you have been plugging away for it for some degree or been climbing the hill for years. THIS IS FOR YOU!!
There is this certain type of bamboo that grows deep in the heart of China and it takes like five- six years to even start to grow but when it does it grows like 90′ ft with in like 6 months! Consider the farmer who plants his crops and does everything he does and needs to for a crop to grow. He has NO idea that things will come about, yet he tries and continues to do what he does for hopes that He will eventually reap a harvest.
You need to have the same attitude, that no matter what you will climb this mountain. You will succeed in your efforts WHAT EVER THEY MAY BE!! No matter if you are trying to get some where in business, make a name for yourself in the music business or in life. You may be trying to deal with something that has kept you down for years and you try and try only to not see anything. For all you know right after the next hill, the next day the next swing your answers will come!
I wanted to just drop you a note of encouragement and give you a little hope for your heart. You need to believe in something so why not believe for the best. It is what keeps you going? To many people failing at something over a 100 times you might begin to think something is impossible. After 150 times you might seriously doubt your sanity and question your motives, yet you would not even think perhaps of trying 200 times, well someone did they pursued with something for nearly 999 times actually on the 100th time BOOM!! the perfect filament for the light bulb was found. http://cache.reverbnation.com/widgets/swf/19/tuneWidget.swf?twID=artist_382803&posted_by=artist_382803&shuffle=&autoPlay=false&blogBuzz=buzz
Well if your trying faint not, if your at least trying to get where you are your doing something. Never give up and never surrender, you never know who is counting on you and how you will change the world or those around you.
Well here I am sitting in my studio wishing I had hair still so I could pull it out. lol I got some killer new upgrades, new gear, software that will enable me to communicate with aliens and a new droid phone. Well maybe not aliens but you get the picture. I am saying I have all these new upgrades and what not but not enough time in the day to learn everything and implement all these new procedures on top of making new music, licensing more music for certain projects and promotions and oh my the list grows.
So you say , “Mark ? What is your problem?” to which I would say …nothing but I thought I would share my drama with you guys for seems like everywhere you turn there is drama on TV, Film, at the grocery store, plus I like sharing with you guys and I enjoy what you share with me.
So, I got this new phone today in the mail my sweet heart angel got this Galaxy Samsung kick butt phone. I swear you could probably launch a satellite with it, or even use it as a can opener. at any rate I have not even scratched the surface of this thing only synced my social network to it and trying to figure everything else out. I thought it would be somewhat silly to share a bit about it and stuff like it.
We live in a generation where a few years ago we would scoff at things like that being used like, who needs cell phone when there are so many phone booths all over the place? Yes the future has come down upon us with a raging fury that would make Attila the Hun proud. In our attempt to work faster and more proficient we have added on another level of stress and added stuff to clutter out minds with the ever-growing frustration to make money to buy more stuff!
I now try to tackle the task to learn how to maneuver thru this land of Apps, shortcuts and their little buttons and social networking issues. I know in the end these things will allow me to create more and work faster and hopefully reach out more to people like yourself. I am really hoping that if I can do a few things in this life it would be to share my music with the world and try to encourage folks all around the globe that there is hope for a better day and a better future.
If you have any ideas , websites, personal helps that you have found in your endeavors to gain understanding with your phone apps or your social networking why not share with every one here, perhaps you will share some wisdom to us folks who are trying not to turn the thing off by sending an email. Remember to smile it is contagious.
